1. Acceptance of Terms

By downloading, installing, or using the Travel Pictures AI mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Travel Pictures AI is an AI-powered mobile application that allows individuals to create professional-quality travel portraits by uploading a single photo and selecting from curated destinations or custom locations. The App uses artificial intelligence to place your photo into stunning travel scenes, creating photorealistic portraits as if you were actually at the destination.

3. User Accounts

3.1 Account Creation

You may use the App as a guest or create a personal account. When creating an account, you must provide accurate and complete information.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscription and Payment Terms

4.1 Premium Membership

Travel Pictures AI offers premium membership plans including weekly and yearly subscriptions. Subscription fees are charged to your Apple ID account at confirmation of purchase.

4.2 Automatic Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your App Store account settings after purchase.

Free trials may be available for new subscribers where supported. Trial periods and terms may vary and are subject to change.

4.4 Charges for AI Generation Attempts

You acknowledge and agree that each attempt to generate an AI-powered travel portrait, regardless of the quality or acceptability of the resulting image, incurs costs to Travel Pictures AI through third-party API services. As such, all generation attempts are subject to charges in accordance with your subscription plan or pay-per-use pricing, as applicable. Charges apply to each generation attempt, including multiple attempts made to achieve an acceptable result. No refunds or credits will be provided for generation attempts that do not meet your expectations, as the service has been rendered and costs have been incurred regardless of the outcome.

5. User Content and Privacy

5.1 Photo Uploads

You retain ownership of all photos you upload to the App. By uploading photos, you grant Travel Pictures AI a limited license to process your images for the purpose of providing the service.

5.2 AI Processing

Your photos are processed using artificial intelligence to create travel portraits. We do not store your photos permanently and process them only as necessary to provide the service.

5.3 Privacy

8. Disclaimers and Limitations

8.1 Service Availability

We strive to provide reliable service but cannot guarantee that the App will be available at all times or free from errors.

8.2 AI Results and Limitations

You acknowledge and understand that the Travel Pictures AI service utilizes artificial intelligence technology to generate travel portraits, and as such, the generated images may not always meet your expectations or produce acceptable results on the first attempt. Due to inherent limitations in current artificial intelligence technology, including but not limited to variations in input quality, complexity of requested compositions, and the probabilistic nature of AI image generation, multiple generation attempts may be required to achieve a satisfactory result.

While we strive to provide high-quality results and continuously work to improve our AI technology, we cannot guarantee that any single generation attempt will produce a perfect or acceptable image. The quality, accuracy, composition, and aesthetic appeal of generated travel portraits may vary significantly between attempts, even with identical input parameters. You understand that achieving an acceptable result may require several attempts, and you agree that such variability is an inherent characteristic of AI-powered image generation services.

Notwithstanding our desire to provide perfect results, current technological limitations in artificial intelligence do not permit us to guarantee consistent, flawless outcomes. You accept that the service is provided "as is" with respect to AI generation capabilities, and you agree to use the service with the understanding that multiple attempts may be necessary to achieve acceptable results.

8.3 Limitation of Liability

To the maximum extent permitted by law, Travel Pictures AI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.

9. Termination

We may terminate or suspend your access to the App at any time, with or without notice, for any reason, including violation of these Terms.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or other appropriate means. Continued use of the App after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Travel Pictures AI operates, without regard to conflict of law principles.
